Ski Klub International Waiver/Release of Liability and Indemnity Agreement

In consideration of being a Ski Klub member which allows me to participate in Ski Klub Internationals' trips/tours & activities, I hereby release, hold harmless and forever discharge Ski Klub International, its trip organizers, owners, officers, directors, agents, employees and volunteers from all claims, causes of action, or demands of every kind which I may have or that any person claiming through me may have against any of them by reason of any injury, damage, sickness, death, accident, financial loss or delay due to any act or default of any transportation companies, lodging properties, hotels, restaurants, ski area companies, cruise ships, tour operators, travel agencies, any travel suppliers, vendors or other person(s) rendering any of the services included in any of the trips, activities or excursions listed on Ski Klub International's emails, flyers or website, including any trips, activities or excursions organized directly or indirectly by Ski Klub International on my behalf (collectively, “Vendors”). I acknowledge Ski Klub International is acting as my agent and that no representation or warranty is made by Ski Klub International regarding the services provided by any Vendors.

I certify that I am in good physical health and am physically able to participate in the trips/tours, activities and excursions organized by Ski Klub International, and assume the risk of participation in such trips/tours, activities and excursions.  I understand and acknowledge that serious accidents may occur during such trips, activities and excursions, including as a result of acts of nature, negligence or actions of others.  I acknowledge that some medical conditions may be exacerbated or aggravated, and that participants occasionally sustain mortal or serious personal injuries and/or property damage as a consequence thereof, and that my participation could result in loss of or damage to my property, serious injury to my body or to others, and/or my death. I acknowledge that Ski Klub International assumes no responsibility for my medical care, funeral expenses, property damage, financial loss, or loss of any kind.

I understand that travel with a group invariably involves compromise to accommodate the diverse desires, travel goals, personalities and physical abilities of group members.  I also understand that while itineraries are planned, they are not a guaranteed schedule of activities, events, or participation, but only a guideline and example.  I acknowledge that group participants must allow for flexibility and changes deemed necessary by Vendors.  I acknowledge that there may be situations beyond the control of Ski Klub International due to geographic, climatic, physical or governmental restrictions that may cause further changes in timing, locations and activities. I understand that there will be no discounts or refunds for trips/tours, or activities curtailed, or otherwise affected by any circumstances listed above. If I bring a claim that is barred by this Waiver/Release of Liability and Indemnity Agreement, or any claims barred by Ski Klub International's Conditions & Policies, I will indemnify Ski Klub International for attorney's fees, expenses and court costs in Ski Klub International's defense of said suit. I acknowledge that there are other means and trips/tours available, and that I am not in an inferior bargaining position, and that I freely accept the responsibility contracted for herein. I agree that this Waiver/Release of Liability and Indemnity Agreement extends to any act or omission of Ski Klub International done at any time where such act or omission is or was done or should have been done to affect or carry out any of the services related to any trips/tours, activities and excursions of Ski Klub International. This Waiver/Release of Liability and Indemnity Agreement is binding on me, my heirs, conservators, guardians, next of kin, personal representatives of my estate, and any other person who would otherwise be entitled to bring a claim on my behalf or for the injuries and property loss (including financial loss) describe herein, including any derivative claims they may have. 

If a dispute arises out of or relates to this member agreement, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or some other dispute resolution procedure. If mediation is not successful, the parties will settle by arbitration. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. In the event that both parties cannot agree on a mediator or arbitrator, then the parties agree to the selection of a mediator or arbitrator by the American Arbitration Association.

In the event of couples, both signatures are required, and both names must be on the membership application.
