Ski Klub International Conditions/Policies
1) All participants/individuals (also refers to as members) on any trips/tours or activities organized by Ski Klub International ("Ski Klub") must read, agree to and accept all conditions & policies set forth in this document. A signed Waiver/Release of Liability and Indemnity Agreement is required as a condition of becoming a member of Ski Klub and allows members to participate in trips/tours or activities offered by Ski Klub. Individuals must be a current paid member of Ski Klub in order to participate in any of Ski Klub's trips/activities. Membership to Ski Klub is on an annual basis, from September to August. Ski Klub membership and annual $15 membership fee is non-refundable and non-transferable. Membership to Ski Klub is on a referral basis from current or past members in good standing and who is also currently listed on our database. All members must be 21 years old or older.
It is strongly recommended that all members purchase trip insurance for all trips organized by Ski Klub, especially if they are planning on attending any European, West Coast, cruise and international trips.
2) DISCLAIMER OF LIABILITY - Ski Klub members acknowledge and understand that Ski Klub, its owners, trip organizers, officers, directors and volunteers only act as agents for suppliers in arranging or selling travel related services, or in accepting reservations or bookings for services that are not directly supplied by Ski Klub (such as air and ground transportation, hotel/condo accommodations, meals, tours, excursions, outings, lift tickets, cruises, etc.), or any services or person(s) rendering any of the services included in the trip/activities listed on Ski Klub's flyers or website . Ski Klub, its owners, trip organizers, officers, directors & volunteers, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, death or injury to members or their travel companions. Unless the term "guaranteed" is specifically stated in writing on your ticket, invoice, confirmation, trip flyer, Ski Klub website, or reservation itinerary, we do not guarantee any of such suppliers' rates, bookings, bedding, reservations, connections, scheduling, or handling of personal effects. Ski Klub, its owners, trip organizers, officers, directors & volunteers shall not be responsible for any injuries, death, damages, delay or losses caused to any member in connection with terrorist activities, social, or labor unrest, mechanical or construction failures or difficulties, weather related, natural disasters, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside Ski Klub's control.
All members assume complete and full responsibility for, and hereby release Ski Klub, its owners, trip organizers, officers, directors & volunteers from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department. For medical information, call the Public Health Service. By embarking upon his/her travel, all members voluntarily assumes all risks involved in such travel, whether expected or unexpected. Members are hereby warned of such risks, and are advised to obtain appropriate insurance coverage against them. Member's retention of tickets, e-mail confirmation or receipt of confirmation from Ski Klub, initial deposits/payments receipt from Ski Klub, submission of Ski Klub membership application or trip reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to member's travel companions.
In the event Ski Klub, its owners, trip organizers, officers, directors and volunteers, arranges or sells trip insurance, ski/snowboard lessons/rental equipment, snowmobile tours, shore excursions, sightseeing tours, bus transfers, or any additional activities/travel services NOT included in the trip packages, or posted on the trip flyers or on the website, they do so as an independent agent, and have no control over personnel, equipment or operations of the travel service suppliers. Therefore, Ski Klub, its owners, trip organizers, officers, directors and volunteers shall not be held liable for any personal injury (including death), property damage, or other loss incurred as a result of any wrongful acts, omissions, or default on the part of the suppliers.
3) DEPOSIT & CANCELLATION POLICY: Reservations are accepted upon receipt of initial deposit or payment with Ski Klub's annual $15 membership fee. Trip registration form, a signed Waiver/Release of Liability and Indemnity Agreement, and Ski Klub's membership application must be received along with trip deposit/payment to confirm your reservation. We cannot confirm your reservation and you may lose your space with penalties if initial payment and/or subsequent payments are not submitted promptly. Payments to Ski Klub are non-refundable unless otherwise stated. Late fees will apply if payments are not made promptly. In the event a reservation is canceled for non-payment by Ski Klub, the member will receive a refund less all cancellation penalties associated with that particular trip.
If a member cancels for any reason on any of Ski Klub's ski trips, non-ski trips, activities, or international trips, he/she must provide a substitute replacement in order to receive a refund less any cancellation penalties, including any additional penalties/fees assessed by our suppliers that were not listed on the trip flyer. This applies to all trips/activities lasting from 1 day to 10+days including day, weekend, East Coast, West Coast, cruise ship trips, land tours, and International trips. There are no exceptions. It is the obligation of the member who cancels to find a substitute replacement, not Ski Klub. Substitute replacements must be found in a timely manner: 90 days prior to departure for trips lasting more than 3 days, and 60 days prior to departure for day/weekend trips. In the event a member fails to find a substitute replacement according to the above 90 days and 60 days conditions, the member forfeits all payments and deposits. In regards to cruise ship trips/tours and non-ski trips/tours, substitute replacements may not be possible, and if possible, it must be done 90 days prior to departure. Substitute replacements for any trips/activities must be friends or family members of the member who is canceling. Substitute replacements found within the Ski Klub organization such as current or past Ski Klub members in good standing are acceptable. Total strangers or substitute replacements found from the general public are not acceptable, and Ski Klub reserves the right to refuse any substitute replacements found in this manner. Substitute replacements for any trips/activities must also agree to and abide by all conditions and policies set forth in this document. Substitute replacements accept all liabilities and responsibilities once they are confirmed as a replacement. Substitute replacements must submit full payment for the entire trip cost before they are confirmed. Assuming a cancelled person's deposits or payments is not allowed. Furthermore, roommates/condo mates and members who cancel a trip for any reason are not allowed to fill their canceled spaces without Ski Klub's knowledge.
a) Ski Klub International and its organizers reserve the right to fill any empty spaces or canceled spaces to fulfill its contractual obligations on all trips/events. Members on any Ski Klub trips/events do not have the right to refuse any roommates or condo mates provided by Ski Klub.
b) In regards to weekend and 1 day ski trips/activities, Ski Klub may be able to find a substitute replacement if there is a waiting list. If Ski Klub provides a substitute replacement on weekend/1 day ski trips/activities, the member who cancels receives a refund less a $35 cancellation fee. This does not apply to West Coast ski trips, European ski trips, international ski trips, or non-ski trips, such as cruise ship and land tour trips. Please review the West Coast, European, International ski & non-ski trips cancellation policies if you are attending those trips.
9) Membership to Ski Klub and its privileges will be immediately revoked if any individual fails to abide and accept the conditions and policies as set forth in this document. Any illegal acts or acts of dishonesty such as "sneaking non-paying individuals" on to any of Ski Klub's trips/activities, theft of products or services from Ski Klub or from its suppliers, or jeopardizes the organization’s relationship with suppliers/vendors, or any acts or actions by members which impeded the operation of the organization or any trip trip/activity, or affected the rights, welfare, or enjoyment of other trip participants will not be tolerated, and the member's membership & privileges will be immediately revoked. Ski Klub reserves the right not to renew membership applications from past and current members whose past actions or past general deportment impeded the operation of the organization including trips/activities, or affected the rights, welfare, or enjoyment of other trip participants.
a) Ski Klub is a private social organization and membership is not available to the general public. Having a referral does not guarantee membership into Ski Klub. Ski Klub reserves the right to refuse membership to any individual regardless if they are a current or non-member. Membership to Ski Klub and its privileges can be revoked or refused at any time if any member fails to abide or violates any condition or policies set forth in this document. In the event a membership is revoked or cancelled, the member's reservation on any current or future trips/activities are also cancelled. Furthermore, Ski Klub reserves the right to cancel any member's reservation for any trip/activity at any time in the event a member becomes problematic and poses a potential risk to the operation of the organization, or any trip/activity, or may be a potential problem to our suppliers, or may affect the rights, welfare, or enjoyment of other trip participants.
INTERNATIONAL AND DOMESTIC ADDENDUM
12) Trips or tours in which meals such as breakfast, lunch, and/or dinner are included in the package, Ski Klub International and its suppliers will try to accommodate individuals with food allergies, or religious obligations. However, there is no guarantee meal substitutions will be available or if possible and is at the discretion of the supplier, not Ski Klub International. Regardless of the outcome, no refunds or adjustments will be made to the cost of the package price if members decline all or any portion of the meal plan.
13) Ski Klub members are allowed to find substitute replacements in the event they are not able to attend any trips or events as stated in item 3 and 3b. Substitute replacement involves taking the entire package. However, members and members who cancel on any trips are not allowed to resell any portions of an event or trip package such as transportation, lodging or ski lift tickets to the general public. In the event an individual cancels for any reason or does not show up, he/she forfeits the entire package, including lift tickets in regards to ski trips. Due to the group discounts that are given to all Ski Klub members by the various ski resorts, lift tickets are part of the lift & lodging package, and all unused lift tickets are not returnable or refundable, and cannot be given to family or friends that are on the trip. Reselling Ski Klub's group lift tickets is illegal and it is punishable by being arrested and/or hefty fines.
14) Unfortunately, due to supplier restrictions we are no longer able to accommodate children under 15 years of age on any trips that involves bus and/or air transportation offered by Ski Klub International.
15) Post Pandemic Addendums: Dated January 20, 2025
B) We no longer will post names of airlines and hotels on the trip flyers. Names of airlines and hotels are released 30 - 45 days before departure. This allows our multiple suppliers to better negotiate and take advantage of better options based on market conditions. This has proven to be very successful on numerous pre-pandemic group tours.
Mediation and Arbitration
If a dispute arises out of or relates to this member agreement, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or some other dispute resolution procedure. If mediation is not successful, the parties will settle by arbitration. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. In the event that both parties cannot agree on a mediator or arbitrator, then the parties agree to the selection of a mediator or arbitrator by the American Arbitration Association.
***All members and potential members are required to review the above conditions and policies, sign a Waiver and Release form, and must agreed to the above conditions and policies as a consideration of becoming a Ski Klub member, and participating on any Ski Klub trips/events.
